Mail Requests
Written requests for copies of court records may be sent to the clerk’s office of the court that handled the case. Each request should include the full case number (if known), party names, the approximate date of the case, and payment for applicable copy fees. The Circuit Court Clerk’s office charges $0.50 per page for copies, with a $2.00 surcharge for each mail request. The office no longer accepts personal checks; payment must be by cash or money order.
Are Court Records Public in Allegany County?
Maryland law establishes a strong presumption that judicial records are open to public inspection. Rules 16-901 through 16-934 of the Maryland Rules of Procedure govern access to all judicial records, whether maintained in paper or electronic form. Under Rule 16-902, any person may visit a record custodian during normal business hours to inspect court records in their custody, subject to certain restrictions.

- Income tax returns contained in case files
- Protective order and peace order petitions (sealed until service or denial)
- Personal identifier information (Social Security numbers, financial account numbers) subject to redaction under Rule 1-322.1
- Unexecuted arrest warrants and certain search warrant materials
Shielding, Sealing, and Expungement
Maryland’s Second Chance Act (Criminal Procedure Article §§ 10-301 through 10-306) permits individuals to petition for shielding of certain criminal records, which removes them from public view on Case Search while preserving them for law enforcement access. Expungement, by contrast, removes records from both court and police files for qualifying dispositions such as acquittals, dismissals, nolle prosequi, and stet entries. Allegany County Criminal Court Records

A court records search does not substitute for a formal criminal background check. Maryland’s official criminal history records are maintained by the Criminal Justice Information System (CJIS) Central Repository within the Department of Public Safety and Correctional Services. Allegany County Sheriff’s Office
The Allegany County Sheriff’s Office handles arrest records and police reports. Requests for these records can be made in person at 695 Kelly Road, Cumberland, MD 21502, or by calling (301) 777-1585.
Expungement
Individuals seeking to expunge criminal records in Allegany County must file a petition with the court where the case was adjudicated. Allegany County Civil Court Records
Civil matters in Allegany County are split between the Circuit Court and the District Court based on the amount in controversy and the nature of the claim. The Circuit Court handles civil cases involving amounts exceeding $30,000 (with concurrent jurisdiction between $5,000 and $30,000 shared with the District Court), as well as equity matters, foreclosures, injunctions, mechanics liens, judicial review of administrative agency decisions, and appeals from the District Court. The District Court handles civil claims of $30,000 or less, landlord-tenant disputes, and replevin actions.

Copy Fees
The Circuit Court Clerk’s office applies the following fee schedule for records:

Land Records
The Circuit Court Clerk’s office serves as the Allegany County repository for land records, including deeds, mortgages, deeds of trust, leases, releases, and land contracts. Filing and Forms
Maryland court forms for civil matters, including fee waiver petitions, small claims actions, and other filings, are available through the Maryland People’s Law Library. Individuals who cannot afford filing fees may petition for a waiver under Maryland Rule 1-325.
Allegany County Family Court Records
Family law cases in Allegany County are primarily adjudicated by the Circuit Court, which has jurisdiction over divorce, annulment, child custody, child support, visitation, paternity, adoption, guardianship, and name changes. The District Court may hear certain domestic violence protective order petitions.
Divorce Records
Divorce and annulment records are maintained by the Circuit Court Clerk’s office. Copies of divorce decrees can be obtained in person or by mail at $0.50 per page for standard copies and $5.00 for certification. The Maryland Department of Health, Division of Vital Records (DVR), also processes requests for verification of divorces filed from 1992 onward. Only the divorced parties, an attorney, or an authorized representative may request divorce verification from the DVR. The fee is $12.00 per verification, payable by check, money order, or credit card.
Marriage Licenses
The Circuit Court Clerk’s office issues marriage licenses in Allegany County. Key requirements based on the official marriage license information:
- Fee: $35.00, non-refundable, payable by cash only
- Application hours: Monday–Friday, 8:30 AM – 4:00 PM
- Waiting period: License is not effective until 6:00 AM on the second calendar day after issuance
- Validity: 6 months from date of issuance
- Documentation required: Government-issued birth certificate or other official government-issued ID for each party; Social Security numbers are mandatory
- Age requirement: As of October 1, 2022, individuals under 17 cannot marry in Maryland; 17-year-olds require a certified court order
- Residency note: If applying in Allegany County, the marriage must take place in Allegany County
Civil ceremonies are performed by the Clerk for a $25.00 fee (cash or money order), Monday through Friday from 9:00 AM to noon and 1:00 PM to 4:00 PM. Non-residents who cannot visit in person may use the Non-Resident Marriage License Application-Affidavit.
Certified copies of marriage records cost $5.50 per copy and can be obtained in person or by mail using the Application for Certified Copy of Marriage License. The DVR also maintains marriage records from 2007 onward, with certified copies available for $12.00.
Birth and Death Records
Although not court records, vital records are frequently sought in conjunction with family law matters. The Maryland Department of Health, Division of Vital Records, handles birth and death certificate requests. Birth certificates cost $10.00 per copy, and death certificates cost $10.00. Domestic Violence and Protective Orders
Petitions for protective orders can be filed at the District Court in Cumberland. Sealed filings are not publicly accessible until served or denied. Victims may request that their address, phone number, and email be shielded from public case records using the appropriate Maryland Judiciary forms.
Adoption and Guardianship
Adoption records and guardianship filings are confidential under Maryland law and are accessible only through a court order or to parties with statutory entitlement. The Circuit Court handles all adoption and guardianship of person and property matters for both adults and minors.
Allegany County Probate Court Records
Maryland does not have a separate probate court. Probate matters are handled by the Orphans’ Court and the Register of Wills. In Allegany County, the Orphans’ Court sits at the James S. Types of Probate Filings
The Register of Wills accepts filings including petitions for probate of wills, petitions for administration of intestate estates, small estate affidavits, inventories and accounts, appointment of personal representatives, caveats, and guardianship of property matters.
Probate Fees
Probate fees are based on the gross value of the estate, as established by Maryland Estates and Trusts Article § 2-206. The current fee schedule applies to estates opened on or after October 1, 2022:

No fees are due on small estates, even those valued between $50,000 and $100,000 when the sole heir or legatee is a surviving spouse. Additional fees include $5.00 for filing a will for safekeeping, $0.50 per page for plain copies, $2.50 per page for certified copies ($0.50 plus $2.00), and $20.00 for caveat filings.
Searching Probate Records
Estate records maintained by the Register of Wills can be searched through the statewide online estate search database using a party name, estate number, filing date, party type, or status. In-person inspection of probate files is available at the Register of Wills office during regular hours. Written requests may also be mailed to the office at 59 Prospect Square, Cumberland, MD 21502, along with applicable copy fees.
Confidentiality in Probate
Most probate records become public once filed, including wills admitted to probate, inventories, and accounts. However, personal identifier information such as Social Security numbers and financial account numbers must be redacted before filing in accordance with Maryland Rule 1-322.1. Guardianship case papers filed under Title 10 of the Maryland Rules are generally not available for public inspection except for docket entries and certain orders.
