Are Court Records Public in Carroll County?

For a comprehensive criminal background check covering all Maryland jurisdictions, the Criminal Justice Information System (CJIS) Central Repository operates under Maryland Code, Criminal Procedure Article § 10-201. Expungement

The Carroll County Clerk’s Office provides expungement information for individuals seeking to have eligible criminal records removed from public access. Expunged records are thereafter treated as confidential and are not available through Case Search or the Clerk’s Office.

Carroll County Civil Court Records

Civil cases in Carroll County are heard by the Circuit Court (claims exceeding $30,000, property title disputes, foreclosures, injunctions, name changes, and appeals from the District Court) and the District Court (claims up to $30,000, small claims, and landlord-tenant disputes). Carroll County Family Court Records

Family law matters in Carroll County — including divorce, child custody, child support, visitation, alimony, paternity, domestic violence protective orders, and name changes — are adjudicated by the Circuit Court. The Clerk’s Office files and maintains records for these proceedings. Juvenile and adoption case records require a court order for access.

Divorce complaints, custody petitions, and related motions are filed with the Clerk’s Office on the second floor of the Courthouse Annex. Records are available for public inspection unless sealed by court order or otherwise restricted. Marriage Licenses and Certificates

Marriage licenses are issued by the Clerk’s Office Land Records & Licensing Department. Applications are accepted Monday through Friday, and both parties must appear. Residents of Carroll County should complete the Resident Marriage Application. Non-residents wishing to marry in Carroll County should use the Non-Resident Marriage License Application.

For copies of marriage certificates from marriages performed in Carroll County, complete the Marriage Certificate Copy Request Form and submit it to the Clerk’s Office. Certified copies cost $5.50; plain copies are $0.50.

Fees are $20 for the first birth certificate copy, $18 for the first death certificate copy, and $20 for each additional copy. Types of Probate Matters

The Register of Wills and Orphans’ Court handle estate administration (testate and intestate), small estates, filing of wills for safekeeping, appointment of personal representatives, guardianships of minors, claims against estates, and caveats.

No fees are due on small estates valued between $50,000 and $100,000 when a spouse is the sole heir or legatee.

Searching Probate Records

The Maryland Register of Wills provides an online estate search tool that allows searches by decedent name, estate number, or county. Records can also be inspected in person at the Register of Wills office during regular hours. Older records that are stored off-site at the Maryland State Archives may require additional retrieval time.
